1. WHO WE ARE
- We are Makeup with Rising Phoenix Sole-Proprietor (Company Registration No.53349614D), trading as http://makeupwithrisingphoenix.com/ (“Makeup with Rising Phoenix”).
- DEFINITIONS
In these Terms and Conditions:
- “Account” means the Makeup with Rising Phoenix Account that you will need to register for on the Site if you would like to submit an Order on the Site;
- “Working Day” means any day on which banks in Singapore are open for business; means a day which is neither (i) a Saturday or Sunday, nor (ii) a public holiday anywhere in Singapore
- ”Order Confirmation” means our email to you, in which we acknowledge your Order;
- “Contract” means your Order of a Product or Products in accordance with these Terms and Conditions as mentioned below;
- “Customer” means any individual who places an Order on the Site;
- “Order” means the Order submitted by you to the Site to purchase a Product from us;
- “You” means the Customer who places an Order;
- “We”, “our”, “us” refers to Makeup with Rising Phoenix.
- PROHIBITIONS
You must not misuse this Site. You shall not commit a criminal offence, transmit or distribute a virus which is malicious, hack into any aspect of the Service; attempt to affect the performance or functionality throughout the Site. Any breach of this provision would constitute a criminal offence under the Computer Misuse and Cybersecurity Act 2013.
- ENTIRE AGREEMENT
These Terms and Conditions shall apply to all Orders and Contracts made or to be made by us for the sale and supply of Products. These Terms and Condition constitute the entire agreement between you and Makeup with Rising Phoenix and supersede any and all preceding and contemporaneous agreements between us.
- TERMS OF SALE
5.1 Registration
(a) To track your Order, you must register with us by creating an Account on the Site. You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes.
5.2 Formation of a Contract
(a) No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your address.
(b) To submit an Order, you will be required to follow the online shopping process on the Site. After this you will receive an Order Confirmation which will act as an acknowledgement of your Order.
(c) An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you.
5.3 Price and Payment
Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Site are accurate, there may be instances where errors may occur. If we discover an error in the price of any Products which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel your Order before we have shipped it to you, and you have already paid for your Order, you will receive a full refund.
(a) Delivery costs will be charged in addition where applicable; such additional charges are clearly displayed and included in the ‘Final Total’.
(c) Payment can be made using PayPal Pte. Ltd., trading as https://www.paypal.com/sg/ (“Paypal Singapore”). Similarly, you can pay all or part of the price of your Order using a promotional voucher.
(d) Once we receive payment through PayPal Pte. Ltd., the Product will be posted within three (3) working days. If we do not receive the required payment, we will not be liable for any delay or non-delivery.
5.4 Mistaken Orders
If you discover that you have made a mistake with your Order after you have submitted it to the Site, please contact admin@makeupwithrisingphoenix.com immediately. We will try our best to process your request.
5.5 Refusal of Order
We reserve the right to withdraw any Products from this Site at any time and/or remove or edit any materials or content on this Site. We may need to refuse to process an Order after we have sent you an Order Confirmation, which we reserve the right to do at any time, at our sole discretion.
If we cancel your Order and you have already made payment for your Order, the payment amounts will be fully refunded to you.
- DELIVERY
6.1 Product delivery will be done via Singapore Post Limited, using registered mail. Please refer to Singapore Post Limited for details regarding registered mail delivery. Currently we only ship to Singapore addresses. However, shipping internationally is in the works, and we will update you once that is available =)
6.2 Our Turn-Around-Time is 3 days. We aim to post the Product to you after our T.A.T from the time of your order checkout (as indicated in the Order Confirmation). We will send the tracking number of the Product to you once the Product has been posted. All our products listed on this website have been handmade by us in small batches, to ensure that you receive spanking new, fresh products which were just manufactured upon your order. Hence there is T.A.T
6.3 We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of delivery after posting the Product.
6.4 You may contact Makeup with Rising Phoenix at admin@makeupwithrisingphoenix.com in case of any faults, defects or damage. You shall be able to provide the documents delivered with the Product, upon request.
6.5 Please note that it might not be possible for us to post immediately after our T.A.T always, especially during public holidays and festive seasons, where the local post offices will be closed. In that case, we will either announce on Makeup with Rising Phoenix website http://makeupwithrisingphoenix.com/ or inform you using the contact details that you provide to us when you make your Order and post at a later date after our T.A.T or arrange for cancellation of the Order, if you wish to be refunded instead.
6.6 If you are unavailable to receive the delivery, you can contact Makeup with Rising Phoenix at admin@makeupwithrisingphoenix.com. If you inform us before we post the Product, we will delay postage. If you inform us after we have posted the Product, you will need to make additional payment for re-postage and we may charge you for any fee and other costs reasonably incurred by us. If collection is delayed due to your refusal without informing Makeup with Rising Phoenix, we may charge you for any fee and other costs reasonably incurred by us.
- RETURNS AND REFUNDS POLICY
7.1 Delivered products are not eligible for returns and refunds, unless there is a cancellation of order by contacting admin@makeupwithrisingphoenix.com.
7.2 Each product listed on this website, has been handmade with love by the both of us. Hence, if you are not completely satisfied with the product you have received, due to damage caused by shipping, do take picture of the product in its original packaging and email us at admin@makeupwithrisingphoenix.com immediately. So that we can make things right and assist you as soon as possible.
7.3 Once an Order has been dispatched it may not be cancelled and the item must instead be returned to the company according to the guidelines provided by via admin@makeupwithrisingphoenix.com. You must return the Product to us within fourteen (14) days of receipt. The Product shall be un-used, Product tags shall not be tampered with, and the Product shall be in the original packaging.
7.4 You shall ensure that the Product is sent to us in the same condition as it was when received by you and is packaged properly. In the event that an item is returned to us in an unsuitable condition, we reserve the right not to refund or to return the product to you.
7.5 You are required to process the return of the Product via Singapore Post Limited, using registered mail, and provide the tracking number to admin@makeupwithrisingphoenix.com. You will need to absorb the delivery cost of returning the Product.
7.6 After we receive your items, a refund shall be issued within the next 3 working days via PayPal Pte. Ltd., trading as https://www.paypal.com/sg/home.
- FAULTY PRODUCTS
8.1 Product image’s color as seen on the Site may slightly differ from the actual Product that you receive.
8.2 We stand by the products that we have created. Hence, if you believe that the item you received is is damaged due to shipping, please contact us at admin@makeupwithrisingphoenix.com and provide your Order number, your name and address, details of the Product and the reason for return. Please allow 1-2 business days for us to get in touch with you.
You are required to process the return of the Product via Singapore Post Limited, using registered mail, and provide the tracking number to admin@makeupwithrisingphoenix.com. You will need to pay the delivery cost of returning the Product.
8.3 Upon receipt of the Products, we will examine it and we will advise you on your right to a replacement or refund (if any) via email. If a replacement or refund is necessary, we will refund the return delivery cost to the customer.
8.4 In the event the Product returned is not faulty, we may at our discretion decide not to repair, replace or refund you for the Product.
- VOUCHERS AND COUPONS
9.1 You may use promotional vouchers or coupons while making payment for Products on the Site.
9.2 If you have a promotional voucher, that voucher can be used by someone other than you and you can assign your rights to use that voucher
9.3 Makeup with Rising Phoenix may at its sole discretion discontinue or cancel any voucher or coupon previously issued and will not be responsible for any losses arising therefrom.
9.4 Conditions for the redemption of promotional vouchers or coupons:
We may distribute promotional vouchers or coupons that may be used only on the Site, which we will send to you either by email or post.
- Promotional vouchers and coupons are valid for the specified period stated on the voucher or coupon.
- Promotional vouchers and coupons can only be redeemed once
- Promotional vouchers and coupons are subjected to their own conditions
- If you place an Order for a Product less than the value of the promotional voucher, no refund will be returned to you.
- If the credit of a promotional voucher is insufficient for the Order you wish to place, you may make up the difference using PayPal Pte. Ltd., trading as https://www.paypal.com/sg/ (“Paypal Singapore”).
- INDEMNITY
You agree to indemnify, defend, hold harmless Makeup with Rising Phoenix, directors and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from your use of this Site or your breach of the Terms and Conditions.
- COMPLAINTS
11.1 You may contact us at any admin@makeupwithrisingphoenix.com. Please allow 1-2 business days for us to get in touch with you. We will attempt to address your concerns as soon as possible and will contact you on receipt of any relevant enquiry or complaint.
11.2 In event your emails may not reach us, or should you not have received any response from us within five (5) Workings Days, please make further enquiries.
- PERSONAL DATA PROTECTION
12.1 Personal Data
Examples of such Personal Data you may provide to us include your name, telephone numbers, mailing address, email address, network data and any other information relating to any individuals which you have provided us in any forms you may have submitted to us, or via other forms of interaction with you.
We are not able to view, access or store your credit card or debit card number. This is for our safety as well as for our customers.
You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with the Products and Services you have requested.
12.2 Purposes for the Collection, Use and Disclosure of Personal Data
Makeup with Rising Phoenix collects, may use and disclose your Personal Data for the following purposes:
- responding to your queries and requests;
- resolving complaints and handling requests and enquiries;
- preventing, detecting and investigating crime;
- organizing promotional events;
- legal purposes (including but not limited to obtaining legal advice and dispute resolution);
- purposes which are reasonably related to the aforesaid.
When you shop on Makeup with Rising Phoenix’s website, we may send you promotional/marketing material via mail along with your order package.
Should you wish to withdraw your consent for us to send you sales, marketing or promotional information via a specific mode, please inform us as follows:
- to withdraw consent from promotional emails: please click on the Unsubscribe link in the promotional emails;
- to withdraw consent from receiving promotional material with your order package: please email customer service, with the words “Promotional Material” in the subject line, at the address provided below.
Please be aware that once we receive confirmation that you wish to withdraw your consent for marketing or promotional materials/communication, it may take up to thirty (30) days for your withdrawal to be reflected in our systems. Therefore, you may still receive marketing or promotional materials/communication during this period of time.

Makeup with Rising Phoenix will take reasonable steps to protect your Personal Data against unauthorised disclosure. Email systems are not always secure. Hence please do not give sensitive information such as your Credit card or Paypal details in your emails to us.
Subject to the provisions of any applicable law, your Personal Data may be disclosed, for the purposes listed above (where applicable), to the following:
- Agents, contractors or third party service providers who provide operational services to Makeup with Rising Phoenix, such as courier services, or other services to Makeup with Rising Phoenix;
- Professional advisers such as auditors and lawyers;
- Relevant government regulators, statutory boards or authorities or law enforcement agencies to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority; and

12.6 Governing Law
This Personal Data Protection Policy and your use of this website shall be governed in all respects by the laws of Singapore.
- CIRCUMSTANCES BEYOND OUR CONTROL
13.1 We shall not be liable to you for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond our reasonable control.
13.2 In the circumstance such an event lasts for more than one week, either you or we may terminate the Contract forthwith by written notice and without any Liability other than a refund of a Product already paid for by you and not delivered.
13.3 If we have Contracted to provide identical or similar Products to more than one Customer and are prevented from fully meeting our obligations due to such as event, we may decide at our absolute discretion which Contracts we will perform and to what extent.
- NOTICES
We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted on-line. However, continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions.
14.1 All content included in or made available through our Site is the property of Makeup with Rising Phoenix or its content. All such rights are reserved by Makeup with Rising Phoenix. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
14.2 In the event Makeup with Rising Phoenix becomes aware of any infringement of its intellectual property, it shall not refrain from taking any relevant legal action.
- LINKS TO THE SITE
You may link to our home page, provided you do so in a way that is legal and is not likely to damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
- WAIVER
No failure or delay by us or you in exercising any right under these Terms and Conditions or a Contract shall operate as a waiver, modify or diminish our or your rights under these Terms and Conditions or a Contract.
- GOVERNING LAW
These Terms and Conditions and a Contract (and all non-Contractual obligations arising out of or connected to them) shall be governed and construed in accordance with Singapore Law.
